Wii, Xbox 360 Controller Lawsuit Appeal Won by Nintendo, Microsoft

Patent lawsuits are depressingly common for the three main platform holders, for everything from rumble functionality, disc-drive usage to joystick implementation. It was pleasing to see then that Microsoft and Nintendo have prevailed in a lawsuit targeting controllers for the GameCube, Wii and Xbox 360.

“We uphold the district court’s grant of summary judgment of no infringement based on the court’s determination that there are no genuine issues of material fact and that no reasonable jury could find that the accused devices of Microsoft and Nintendo meet the pulse width limitation of the asserted claims of Fenner’s U.S. Patent No. 6,297,751 literally or under the doctrine of equivalents,” reads the court document uncovered by Bloomberg. “We need not and do not address Microsoft’s alternate ground for 2009-1496 2 affirmance, nor do we address the question raised by Fenner whether the district court erred in its construction of the claim term 'processor.'”

While Microsoft had no comment, the Nintendo of America general counsel said the ruling was “consistent with Nintendo’s longstanding policy of respecting the intellectual property of others.”

The lawsuit was originally filed in 2006 by Anascape, a small Texas-based company that claimed that Nintendo's designs for its Wii Classic, WaveBird and GameCube controllers infringed upon 12 patents granted to Anascape covering technologies including analog sensors and feedback and vibration mechanisms.
