In the second legal win for Nintendo this month, a British high court judge has ruled against importers Wai Dat Chan and Playable Limited in a recent case. With the ruling, it is no longer legal to import, sell, or advertise R4 cartridges anywhere in the U.K.
A new precedent was set by the high court by judging it illegal to override Nintendo’s security systems in order to play unauthorized DS content. This ruling would also affect those who use systems to add homebrew and emulators to the DS.
“Nintendo promotes and fosters game development and creativity, and strongly supports the game developers who legitimately create new and innovative applications,” said the company in a statement. “Nintendo initiates these actions not only on its own behalf, but also on behalf of over 1,400 video game-development companies that depend on legitimate sales of games for their survival”.
This is an interesting ruling as only a day ago federal regulators in the U.S. found it was lawful to "jailbreak" Apple’s iPhone to allow the installation of unauthorized software. It was decided that such actions are allowed as fair use under the Digital Millennium Copyright Act.
