Nintendo Wins Preliminary Ruling Against Motiva Over Wii Patent

Posted November 3, 2011 by James Brightman

Nintendo has prevailed in a case that saw a company called Motiva accusing the Big N of patent infringement. Motiva had alleged that Nintendo's Wii infringed their patent for systems to track a user's position and body movement. Now a decision has been reached and it's not good for Motiva.

A judge at the International Trade Commission said in a preliminary decision that Nintendo did not infringe Motiva's two patents. A final decision is expected to come in March. In the meantime, the preliminary decision can be reviewed by the commission to either be accepted or altered.

"Nintendo has a long history of developing innovative products while respecting the intellectual property rights of others," said Nintendo General Counsel Rick Flamm in an email statement. "Nintendo is confident that, if the full International Trade Commission reviews the decision, it will reach the same outcome."

Nintendo was also recently sued by another company called ThinkOptic in yet another Wii-related patent case.
