iPhone 4S Could Get Hit With EU Ban Care Of Samsung

Do you live in France or Italy?  Are you excited about getting your iPhone 4S this month?  Well, if Samsung has anything to say about it, you’ll be waiting for awhile.  The Korean electronics manufacturer has told The Guardian that it will be filing preliminary injunctions against Apple in France and Italy.  The battle that began when Apple filed injunctions against the Samsung Galaxy line of smartphones and tablet computers earlier this year has shifted into second gear.

The iPhone 4S is a world phone, and as such, it combines both GSM and CDMA communication systems into a single phone.  France and Italy currently use GSM, but every iPhone 4S will contain both systems, and Samsung is saying that will violate several patents it has on WCDMA.  Samsung has also admitted that it may file in other territories “after further review”.

"Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology, and we will steadfastly protect our intellectual property," Samsung said in a statement.

Apple won injunctions against Samsung’s products in Netherlands and Germany, so Samsung is probably in this one for the long haul.  Begun these patent wars have.
