GameStop Hit With Suit Over Mandatory Security Checks for Employees

Posted November 23, 2011 by M.H. Williams

This is an odd one. A class action lawsuit against GameStop has been filed by a former employee with the Superior Court of California. The class-action encompasses all individuals who worked for the retailers from June, 21, 2010 to the present.

I enjoy losing a third of my break for a pat down! Thanks, boss!

The reason for the suit? GameStop has a mandatory security check for all employees when they go on any break or finish a shift. California law says that employees get a 30-minute break every five hours worked and a 10-minute break every four-hour shift. The problem is that the security check is taken out of break time, and thus employees are not compensated for that time.

The suit goes on to allege that GameStop does not adequately compensate employees for shifts longer than eight hours and that wage statements are incorrectly itemized. The suit seeks an hour's pay for each day in which proper breaks were not given, and any other damages determined by the Court.
