According to an SEC filing, Interplay indicated that Bethsoft has dropped its appeal that would prevent them from distributing Fallout, Fallout 2 and Fallout: Tactics and to work on the MMO Project V13. The contentious legal sparring will continue, however, as Interplay vowed to continue its counter-suit against Bethsoft.
“Interplay will continue to defend its rights and to pursue its Counter-Claims against Bethesda, for among other things, Breach of Contract and Declaratory Judgment and an award of damages, attorney fees and other relief,” reads the SEC filing by Interplay.
The legal rumblings over the Fallout license began early in 2009 and officially commenced in September 2009 with Bethsoft accusing Interplay of breach of contract. Bethsoft's initial injunction was denied, though the company continued its legal pressure until this most recent motion.
