Interplay, it would appear, gets to keep on trucking on its MMO version of the Fallout franchise. Bethesda‘s appeal against the court’s original decision to deny a preliminary injunction against Interplay has also been denied. This is not the first injunction against Interplay that has been denied.
According to documents from the United State Court of Appeals, Bethesda attempted to prove that the “district court abused its discretion and misapplied the law in concluding that Bethesda failed to establish a likelihood of irreparable harm.” Obviously, the court did not look fondly on the developer’s argument.
And so the ongoing legal war between Bethesda and Interplay continues. Unfortunately, this is not the only legal battle that Bethesda is currently losing, as the company was the successful target of an injunction related to Mojang’s upcoming Scrolls title.
