Activision's Suit Against Former Infinity Ward Heads will Proceed

The Los Angeles Superior Court has denied a motion brought by Electronic Arts for summary judgment. What this means is that Activision Publishing's $400 million contract-interference suit against EA will proceed.

Judge Elihu Berle denied EA's motion, saying there was enough evidence to warrant a jury trial over EA's alleged interference with Activision employment agreements with Jason West and Vince Zampella and that the publisher contributed to their alleged breach of fiduciary duties to Activision. West and Zampella, who headed up Infinity Ward and helped create the Call of Duty franchise, made a similar summary judgment that was also denied.

So now the case will proceed as normal, with a jury trial scheduled for May 7, 2012. West and Zampella's suit against Activision will convene on the same day, assuming a settlement in both cases isn't reached beforehand.
